Somebody came into my offices yesterday, they’d gone to another company who is “licensed”, in order to try and obtain help in dealing with their debt. That was the first company they met with, and they went ahead and proceeded down the path with them.
Unfortunately, what the client didn’t understand was, just because they’re licensed does not mean that they can represent the client’s best interest. The company structured a proposal to creditors, which is a formal legal process and if done properly is the best way to deal with debt in Canada.
But what happened was, that proposal when presented to the creditors, was then not accepted by the creditors. What do you do then? The response that the individual received, who is now becoming our client, the response they received from the licensed person who they were working with was “Well, offer double of what you offered or go bankrupt.” Let me tell you something, that does not happen in our office. That does not happen to our clients.
When you obtain proper, professional, representation that can represent only your interests, solely your interests, when going through the process of dealing with debt, typically, the outcome is much different. It’s more so in your favor. And if it’s in your favor, it means that it also works for the creditors, because you’re not going bankrupt, the creditors are getting something.
And so what the debtor at that time (who is our client … we don’t call our clients debtors, we call them clients. The system calls them debtors, if you will). What the client was not told at that time was; they had multiple options to deal with that proposal which was turned down. They had a period of time where a creditors meeting could have been called. They could have made counteroffers. They could have made a request to withdraw their proposal. They could have even requested to see the voting letters to see how the different creditors voted on their proposal and then put together a strategic plan to go back to whatever creditors said no to the proposal.
None of that was done. The client wasn’t told that they had any of those options. Next thing you know, they’re calling our office saying, “Hey, I had a proposal submitted, but they’re saying it’s not accepted and they’re telling me I now have to go bankrupt.” Folks, dealing with debt is a very serious matter and the debt industry is a little bit of a mess, the debt relief industry that is. A consumer doesn’t really know who’s working for who and how everybody gets paid.
